These Terms & Conditions (the “Terms”) are a contract between you and Silver Footfalls (“we”, “us”, “our”), the operator of the website at silverfootfalls.com (the “Site”). We are based in the United Kingdom. By accessing or using the Site you agree to these Terms. If you do not agree, you must not use the Site.

1. What Silver Footfalls is

Silver Footfalls publishes fiction stories in audio and written form, generated with the assistance of artificial intelligence. The Site is open to everyone. Some stories are sexually explicit and intended for adults only; where they are, we place them behind an age check (see section 2). All of the content is fiction. It does not feature real performers, and every character depicted in a sexual context is a fictional adult aged 18 or over. See our Content & AI Statement for detail.

2. Adult content and age checks

The Site is open to everyone. Some content is sexually explicit and is for adults only. You may only access, buy, or use that adult content if you are aged 18 or over and it is lawful for you to view sexually explicit material where you are located.

Where the Site offers sexually explicit content, we use age assurance to confirm that users are adults before they can view that content, and we may ask you to verify again. Confirming your age is a condition of accessing adult content. How this works, and what data is involved, is explained in our Age Verification policy.

3. Your account

You create an account with an email address and a password. You are responsible for keeping your password secure and for activity that happens under your account on the Site. Tell us at admin@silverfootfalls.com if you think your account has been used without your permission. We may suspend or close accounts that break these Terms, our Acceptable Use Policy, or the law.

4. What costs money, and what does not

Half of every story is free. For each story we publish, at least half of its chapters can be read, listened to or watched by anyone, with no account, no payment and no email address. Where a story has an odd number of chapters, the extra one is free rather than paid.

The free half stays free. Once a chapter is in the free half we will not move it behind the paywall. If a story turns out shorter than planned, the chapters already free remain free.

The remaining chapters need a membership, which you buy from Patreon, not from us. A membership unlocks the paid chapters of every story on the Site for as long as it lasts. You then link your Patreon account to your account here so we can check it.

Explicit chapters are age-restricted whether they are free or paid. Paying for a membership does not clear the age check, and never will.

5. Your membership, and payment

Patreon is the seller of the membership. It takes the payment, sets the price you see and handles billing. Your membership is subject to Patreon’s own terms as well as these. We never receive or store your card details.

A membership is access while it lasts, not a purchase you keep. It renews automatically until you cancel, you can cancel at any time through Patreon with no minimum term, and your access continues until the end of the period you have paid for. When it ends, the paid chapters lock again — the free half does not.

If you bought individual chapters from us in the past, those remain yours. We honour them permanently and they do not depend on any membership. We no longer sell chapters individually.

6. Your licence to the content

All stories, audio, text, images and other material on the Site are owned by Silver Footfalls or our licensors and are protected by copyright and other rights.

Whether you are reading a free chapter, using a membership, or accessing something you bought before we stopped selling chapters individually, you receive a personal, non-exclusive, non-transferable, revocable licence to stream and privately enjoy that content for your own non-commercial use, for as long as we make it available. You must not:

• copy, download (beyond ordinary streaming/caching), reproduce, or redistribute the content;
• share, resell, sub-licence, rent, lend, or make the content available to anyone else;
• share your account or your access with anyone else;
• remove or circumvent any access control, watermark, or security measure;
• scrape, crawl, or systematically extract content from the Site in a way that disrupts or overloads it, or that bypasses the age check or any other access control.

AI training is permitted. You may use content from the Site to train, fine-tune, evaluate, or develop AI and machine-learning models, and for text and data mining. We do not reserve our rights for the purposes of any text-and-data-mining exception or opt-out. That permission is to learn from the content, not to republish it: the restrictions above still apply to the stories and audio themselves.

7. Cancelling, and refunds

Cancel any time. You cancel a membership through Patreon, not through us. There is no minimum term and no notice period, and your access runs until the end of the period you have already paid for.

Refunds are Patreon’s to give. Patreon takes the payment, so a refund request goes to Patreon under its terms. If we withdraw a story or the Site while your membership is running, contact us and we will help you take it up with them.

Where you bought a chapter from us individually in the past: that content was digital and supplied immediately, so the 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 was lost once supply began with your agreement. Those purchases are non-refundable except where the law gives you a refund — for example if the content is faulty, not as described, or not of satisfactory quality under the Consumer Rights Act 2015. Nothing in these Terms affects your statutory rights.

8. Acceptable use

You must use the Site lawfully and in line with our Acceptable Use Policy. In short: don’t break the law, don’t share or resell what you read, don’t share your account or your membership, don’t attack or abuse the Site, and don’t access the adult content if you are under 18.

9. Content disclaimer

Everything on the Site is fiction created for entertainment. Stories, characters, names, and events are imaginary; any resemblance to real people or events is coincidental. The content is not advice of any kind and does not depict real people or real events. Content is provided for your enjoyment only.

10. The Site is provided “as is”

We provide the Site with reasonable care and skill, but to the extent the law allows we make no warranties that the Site will be uninterrupted, error-free, or always available. We may change, suspend, or withdraw the Site or any content at any time. Where we permanently remove content you have paid for, we will try to give reasonable notice and offer a fair remedy.

11. Our liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, to the fullest extent permitted by law we are not liable for any indirect or consequential loss, and our total liability to you arising from your use of the Site or any purchase is limited to the amount you paid to us in the 12 months before the claim. This does not affect your statutory rights as a consumer.

12. Suspension and termination

We may suspend or end your access to the Site or to purchased content if you seriously or repeatedly break these Terms or the Acceptable Use Policy, if required by law, or to protect the Site or other users. Where it is fair to do so, we will tell you why.

13. Changes to these Terms

We may update these Terms from time to time. The “last updated” date shows when. For significant changes we will take reasonable steps to tell you. Continuing to use the Site after changes take effect means you accept the updated Terms.

14. Governing law and disputes

These Terms and any dispute arising from them or from your use of the Site are governed by the law of the United Kingdom, and you and we submit to the non-exclusive jurisdiction of the UK courts. If you are a consumer living outside the UK, including in the EU, you keep the benefit of any mandatory consumer protections that the law of your home country guarantees.
